Hazardous Waste Regulations Update

Earlier this month the Hazardous Waste Regulations changed in that if your premises produce less than 500kg of hazardous waste you no longer have to register with the Environment Agency. This change currently only affects England.

This new threshold replaces the previous 200kg limit that has applied since the regulations were introduced in 2005.

The change means that if you produce more than 200kg and are already registered with the EA, you do not have to renew the registration when it becomes due, providing you produce less than 500kg. If you think you may be in or around the 500kg limit then we recommend you register. It is better to be safe than sorry! However, for the vast majority of our customers, the limits are far too small for the change to be significant and your status for registration will remain the same.

What doesn't change is that hazardous waste has to be disposed of correctly. It is still an offence under the 2005 Regulations to produce or remove hazardous waste from premises, unless those premises either are registered with the EA or are classified exempt.

It is also still necessary for a consignment note to accompany any shipment and a carrier must be registered with the EA.
